JollyHop (hereinafter, also referred to as "Company", "we", "our", or "us"), an online travel agency, administered and operated by its namesake company with its registrated office in McKinney TX, USA, grants access to the website jollyhop.com, its content and travel booking services (collectively referred to as “Services”) to you (also referred to as also referred to as “users”, “customers”) under the following terms and conditions (hereinafter, also referred to as “Terms” or “Terms of Use”).

Your use and access of the Services are considered acceptance of these terms and conditions. If you do not agree to our Terms, you may stop using the Services.

1. Scope of Terms

The Terms cover the terms and conditions disclosed on this page, prompted when you proceed with your travel booking or shared with you after completion of your travel booking, purchase of any related ancillaries, booking changes, cancellation or refund.

2. General Notice

2.1. JollyHop does not act as a principal travel supplier but as a travel booking platform where you can search, compare, and book travel services offered by travel suppliers (airlines, car rental companies).

2.2. The booking includes certain fees charged by the travel supplier(s) for their services, taxes, and other charges, besides the base price. In addition, the booking amount includes JollyHop Agency Service fee.

2.3. The booking amount may include additional charges for certain services (For example, baggage fee by airline for items beyond the baggage allowance or insurance fee/drop fee by car rental agencies) at the time of check-in. You are solely responsible for any such additional charges due to the travel supplier. If you have any questions about such charges, please contact the relevant travel supplier directly.

2.4. You authorize JollyHop and its affiliate companies to book reservations or enter a contract on your behalf with the travel supplier you select for the total price displayed, including such fees and any applicable taxes or charges related to the travel supplier’s or JollyHop’s services.

3. Site Usage and Bookings

3.1. If you make a booking over the telephone, we may ask for essential information, including personal and payment information, to comply with the travel supplier’s guidelines. The name and address details of yours, and/or of the fellow passengers, shall be the same as recorded on the respective valid photo ID issued by any government authority of the residential territory of the individual traveler.

3.2. In case of international travel, we need the particulars as mentioned above from the passports of traveling members. JollyHop expects and assumes that you are providing information correct to the best of your knowledge. In no situation will any type of name changes be accepted by JollyHop or the concerned travel supplier beyond the expressed terms or rules governing the purchase or booking. We assume that you are using a credit, debit card, PayPal, or any other accepted payment account legally owned by you. In case you are not the card or account holder, you should have authorization of the payment card or payment account holder. If a booking is confirmed, we will debit payment from your payment card or payment account and send you a confirmation invoice. If you notice any errors on the booking receipt/ticket, you must report it on the same day.

If any fluctuation in airline fares or car rental rates happens after the collection of payment details or before the actual booking, the real-time fares are applied, and the corresponding amount is debited from the payment card or account. An email confirmation is also sent to you from our end regarding the change, if any.

4. Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts under applicable law. You agree to provide accurate, current, and complete information as required during the booking process.

5. Services Offered

We offer online booking for:

  • Flights: Domestic and select international air travel within/from the United States.
  • Car Rentals: Vehicle rentals through third-party providers at various U.S. locations.
  • Travel Insurance: Purchase of travel insurance to safeguard your travel bookings.

All bookings are subject to availability and the terms of third-party providers, including airlines and car rental agencies.

6. Third-Party Providers

Our website enables travel booking for third-party airlines, car rental companies, and service aggregators. When you book through us, you are also entering into a separate agreement with those providers. You understand that the terms and conditions and privacy practices under the agreement are beyond the control of jollyhop.com.

7. Billing

7.1. We accept payment cards (credit/debit) based on MasterCard, Visa, American Express, or Discover payment network issued by banks within North America or beyond. Additionally, we also accept PayPal payments. However, an additional 5% fee is applicable for all PayPal payments.

If you think that your payment card or account has been overcharged, please contact our travel consultant on the toll-free number 1-844-869-5221. Please note that airfares are guaranteed once the ticket is issued, and not upon payment processing. If your payment is not processed for any reason, we will inform you within 24 hours.

7.2. You have the flexibility to make the payment through one or more cards or accounts. However, opting for multiple payment cards/accounts comes at an additional 4% fee on the total ticket cost.

8. Payment card verification

For security purposes, we perform verification of the cardholder’s identity after payment is made. This may include a copy of the payment card (with only the last four digits visible), government-issued photo identification, or any other supporting documentation deemed necessary. All bookings remain provisional until the payment is verified. Your reservation will only be fully confirmed once the verification process is successfully completed. If the cardholder fails to provide the requested verification documents within the specified timeframe, JollyHop reserves the right to cancel the booking. In such cases, refunds (if applicable) will be processed in accordance with our cancellation and refund policy.

9. Credit card decline

9.1. JollyHop contacts you to inform you of any credit card payment decline within 72 hours. The credit card declining results in the transaction failure. We do not guarantee the stability of the fares or the booking confirmation with future booking and payment attempts.

10. Infant Policy

An Infant is a traveler who should be under two years of age throughout the travel. If an infant turns two years of age during the travel, airlines may charge a child fare. With one adult, only one infant is allowed on the adult’s lap. If there are two infants with one adult, the ticket for the second infant will be booked under the applicable child fare.

11. Unaccompanied minor

In general, children between the ages of 5 and 17 traveling alone, domestically or internationally, are considered unaccompanied minors. Selected airlines facilitate a special, often paid service from boarding at the departure airport to transferring the child to the authorized adult at the arrival airport. The terms, scope of service, and fee vary from airline to airline. Some airlines allow unaccompanied minors to travel on non-stop flights only. Some airlines do not allow minors to travel without not accompanied by an adult.

12. Pricing, Payments, Fees

All prices are displayed in U.S. dollars unless otherwise specified.

12.2. Car Rental Bookings

The airfares are dynamic. Payments are due at the time of booking. Additional charges/penalty may apply to your booking if you opt for add-on services offered by the car rental company or violate its booking/driving terms.

13. Cancellations, Refunds & Changes

Cancellations or changes to your booking may be subject to travel supplier or provider-specific rules and/or penalties. Please review the specific cancellation policy displayed at the time of booking. jollyhop.com levies a travel agency service fee. There are no refunds for non-refundable fares/car rental prices, missed flights, or no-shows.

14. Resolution of disputes

Please read this section carefully. It affects your rights and will have a substantial impact on how claims you and we may have against each other are resolved.

JollyHop is committed to customer satisfaction. If you have a problem or dispute with our services, we will try to resolve your concerns. If we are unsuccessful in resolving your concerns, you may pursue claims as explained below.

You agree to give us an opportunity to resolve any disputes or claims relating in any way to this website, any dealings with our booking agents, any services or products provided, any representations made by us, or our Privacy Policy by contacting 1-844-869-5221. If we are not able to resolve your concerns within 60 days, you may seek relief through arbitration as set forth below.

You and we agree that we will resolve any dispute, claim or controversy arising out of or relating to your use of the Site, these Terms & Conditions, or the breach, termination, enforcement, interpretation or validity thereof, or our relationship in connection with the Site or previous versions of these Terms & Conditions (each, a “Claim”), in accordance with one of the subsections of this Resolution of Disputes section below or as otherwise mutually agreed by the parties in writing.

15. Changes to the Terms

JollyHop reserves the right to change, modify, add, or remove portions of these Terms and Conditions at any time. If we make changes to these Terms and Conditions, we will post the revised Terms and Conditions on the Site. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

16. Mandatory arbitration

Any and all Claims will be resolved by binding arbitration initiated through the American Arbitration Association (AAA) except for claims asserted on an individual basis that are properly filed in a small claims court or other court of competent jurisdiction having a jurisdictional limit of U.S. $5,000 or less, excluding costs, interests, and attorneys’ fees.

Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, and court review of an arbitration award is very limited. However, except as set forth below, an arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. An arbitrator should apply the Terms & Conditions as a court would.

Payment of all filing, administration, and arbitrator fees will be governed by the AAA rules. You may choose to have an arbitration conducted by telephone, based on written submissions, or in person in the state where you live or at another mutually agreed location.

Notwithstanding the provision above with respect to applicable substantive law, any arbitration conducted pursuant to these Terms & Conditions shall be governed by the Federal Arbitration Act (9 U.S.C., Secs. 1-16). AAA and the parties must comply with the following rules: (a) the arbitration shall be conducted by a single arbitrator approved by or otherwise affiliated with AAA; except that if the total amount in controversy is more than US $100,000, the defendant may request a panel of three arbitrators; (b) the party initiating the arbitration shall choose the form in which they would like the arbitration to be conducted: via telephone, online, solely based on written submissions, or at an in-person hearing; (c) notwithstanding the foregoing, if either party requests an in-person hearing: (i) the arbitrator shall decide whether a hearing is necessary or whether the arbitration should proceed via telephone, online or solely based on written submissions, (ii) if the arbitrator deems that a hearing is necessary, the hearing shall occur at a mutually agreed upon location, or, if the parties are unable to agree on a location, at a location that is selected by the arbitrator and is reasonably convenient to all parties, and (iii) either party may elect to participate in an in-person hearing by phone, unless the arbitrator decides otherwise; (d) the arbitrator may not award any: (i) incidental, indirect or consequential damages, including damages for lost profits, or (ii) punitive or exemplary damages, except where permitted by statute, and the parties waive any right to recover any such damages described in subparagraphs (d)(i) and (d)(ii); (e) the arbitrator may award injunctive or declaratory relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party`s individual claim; and (f) unless otherwise mutually agreed by the parties in writing, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

The arbitrator may not decide issues relating to arbitrability and the scope or enforceability of this Mandatory Arbitration provision, which shall be only for a court of competent jurisdiction to decide. Judgment on the award issued by the arbitrator may be entered in any court having jurisdiction. This Mandatory Arbitration provision shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.

YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS AND CONDITIONS, WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION OR PROCEEDING WITH RESPECT TO THE CLAIM COVERED BY THIS MANDATORY ARBITRATION PROVISION.

17. Improperly filed claims

All claims you bring against us must be resolved in accordance with this Resolution of Disputes section. All claims filed or brought that are not in accordance with to this section shall be considered improperly filed. Should a claim be filed by either you or us in manner that is not in accordance with this section, the other party may seek to recover attorneys` fees and costs up to US$5,000, provided that the other party has been notified in writing of the improperly filed claim, received fourteen days to withdraw such claim, and fails to do so.

18. User Conduct

You agree not to:

  • Use our platform for fraudulent or illegal activities.
  • Interfere with or disrupt the integrity or performance of the services.
  • Attempt to gain unauthorized access to systems or data.

19. Intellectual Property

All content, trademarks, and logos on our site are owned by or licensed to JollyHop and are protected by U.S. and international copyright laws. Unauthorized use is prohibited.

20. Disclaimer of Warranties

Service “As-Is”

  • All flight and car rental bookings made through JollyHop are provided on an “as-is” and “as-available” basis. We make no representations or warranties, express or implied, regarding the accuracy, reliability, completeness, or availability of booking information, schedules, fares, vehicle details, or third-party services.

No Guarantee of Availability

  • JollyHop does not guarantee that flights, vehicles, prices, or promotional offers displayed on our platform will remain available at the time of booking. Final confirmation is subject to the airline, car rental provider, or third-party supplier.

Third-Party Services

  • As we act as an intermediary between customers and airlines, car rental providers, or other travel suppliers, JollyHop is not responsible for the quality, safety, timeliness, or performance of services provided by third parties. Any claims, issues, or disputes must be directed to the relevant service provider.

No Warranty Against Interruptions

  • We do not warrant that our website, mobile app, or booking system will operate uninterrupted, error-free, or free of viruses or harmful components.

Limitation of Implied Warranties

  • To the fullest extent permitted by applicable law, JollyHop expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

21. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of our services, including loss of profits, data, or goodwill.
